Definition: “Customer” shall mean the customer or any person acting on behalf of and with the authority of the Customer. “Shadetech” shall mean Livelso Pty Ltd trading as Shadetech.

Any instructions received by Shadetech from the Customer for the supply of goods/services and or the Customer’s acceptance of such shall constitute acceptance of the terms and conditions contained herein.

Cancellation: A fee is payable to cover any costs incurred by Shadetech from the time of acceptance to time of cancellation i.e., construction of posts, building permits and administration.

The normal trading terms of Shadetech are COD payment by cash, cheque, direct deposit or credit card. 40% deposit or purchase order is required to proceed with the quote. Acceptance of a purchase order over a deposit is at the discretion of Shadetech.

Ownership of goods shall not pass to the customer and will remain the property of Shadetech until payment is received in full. Until ownership has passed, the Customer holds the goods on behalf of Shadetech on the following conditions:

1. Shadetech is permitted to enter on to the Customers premises (whether occupied by the Customer as proprietor, lessee or otherwise), or the premises of any associated company or agent where the goods are located, without liability for trespass or any resulting damage and retake possession of the goods; and

2. to keep or resell any goods repossessed pursuant to the above.

Shadetech also reserves the right to suspend deliveries of further goods if the terms of payment are not strictly adhered to by the Customer. Please note should your account exceed our trading terms and be handed over for collection, all costs including commission, solicitor’s fee and any out-of-pocket expenses will be the liability of the Customer.

Payment shall become due immediately upon the commencement of any act or proceeding in relation to the Customer’s insolvency.

Claims must be submitted in writing to Shadetech within 3 days of installation, claims after this period will be rejected.

The construction cost quoted is based on the expectation of ‘clear digging’. If the builder strikes rock, additional rock breaker charger costs will apply @ $150 per hour plus equipment.

It is the owner’s responsibility to inform Shadetech of any existing pipes and/or electrical or telephone cables that are in existence, prior to the commencement of construction.
Shadetech takes no responsibility for any cables/pipes/irrigation etc damaged by digging where the customer has not supplied a site plan showing location of pipes, cables and wires.

The price quoted is also subject to a satisfactory inspection of the site by a representative of Shadetech and the company reserves the right to vary the quote prior to placing an order, should a site inspection reveal factors that would add to the installation cost.

Shadetech offers a 2-year workmanship warranty. All our materials are of the highest grade and come with different grades of warranty.

It is against our internal OH&S procedures to enter the premises if our site team are not satisfied that the dogs are constrained.

All trees and branches that may affect or come into contact with the shade sail are to be removed by the customer. Shadetech’s OH&S policies do not allow site team members to remove trees and branches. By signing this form the customer acknowledges that the final installation may not be completed until the branches /trees affecting the shade are removed.
